N.Y. Mental Hygiene Law Section 13.39
Registration and notification of boards of directors or trustees of certain voluntary not-for-profit facilities or corporations


(a)

Notwithstanding any other law, rule or regulation, the executive director, chairperson or president of a voluntary, not-for-profit corporation or facility which is subject to the jurisdiction of the office for people with developmental disabilities shall furnish annually to the commissioner a list of the names and addresses of the current members of the board of directors or trustees of such facility or corporation. Failure to furnish such annual list shall remove such facility or corporation from consideration for recertification.

(b)

In the event that such facility or corporation is found to be in violation of the provisions of this chapter or of rules and regulations promulgated by the commissioner pursuant to this chapter which could result in the revocation, cancellation, limitation or suspension of the operating certificate of such facility and if notice of such violation is provided to the facility pursuant to such regulations, a copy of such notice shall be provided to each of the current members of the board of directors or trustees of such facility or corporation by the commissioner.

(c)

The commissioner is authorized to promulgate such rules and regulations as are necessary to implement the provisions of this section.
