N.Y. Executive Law Section 93
Custody of records

1.

The secretary of state shall have the custody of all laws and concurrent resolutions of the legislature, all documents issued under the great seal, all books, records, deeds, parchments, maps and papers deposited or kept in his or her office, and shall properly arrange and preserve them.

2.

The records in the custody of the secretary of state need not be retained in the form in which the record is received so long as the technology used to retain such record results in a permanent record which may be accurately reproduced during the period for which the record is required to be retained. The secretary of state may promulgate rules and regulations relating to the use by the department of state of automatic data processing, telecommunications and other information technologies for the processing of records for retention by the department of state.
