Schenectady parking authority


1.

A board to be known as “Schenectady Parking Authority” is hereby created. Such board shall be a body corporate and politic, constituting a public benefit corporation, and its existence shall commence upon the appointment of the members as herein provided. It shall consist of a chairman and four other members, who shall be appointed by the mayor, with the advice and consent of the city council. Of the members first appointed, one shall be appointed for a period of one year, one for a period of two years, one for a period of three years, one for a period of four years, and one for a period of five years. At the expiration of such terms, the terms of office of their successors shall be five years. Each member shall continue to serve until the appointment and qualification of his successor. A member may be removed at will by the mayor with the approval of the city council, giving him a copy of the charges against him and an opportunity of being heard in person, or by counsel, in his defense upon not less than ten day’s notice. Vacancies in such board occurring otherwise than by the expiration of term shall be filled for the unexpired term by the mayor, with the advice and consent of the city council. The members of the board shall choose from their number a vice-chairman and such other officers deemed desirable by the board. The members of the board shall be entitled to no compensation for their services but shall be entitled to reimbursement for their actual and necessary expenses incurred in the performance of their official duties. The powers of the authority shall be vested in and exercised by a majority of the members of the board then in office. Such board may delegate to one or more of its members or to its officers, agents and employees such powers and duties as it may deem proper. Such board and its corporate existence shall continue only for a period of fifteen years, and thereafter until all its liabilities and duties have been met, and its bonds have been paid in full or such liabilities and duties or bonds have otherwise been discharged. Upon its ceasing to exist, all its rights and properties shall pass to the city.

No public officer or employee shall be ineligible for appointment as a member or officer of the authority and any public officer or employee may accept such appointment and serve as a member or officer without forfeiture of any other public office or position of public employment by reason thereof. Any one or more members or officers of the authority may be an officer or employee of the city. In the event that an officer or employee of the city shall be appointed as a member or officer of the authority, acceptance or retention of such appointment shall not be deemed a forfeiture of his city office or employment, or incompatible therewith or affect his tenure or compensation in any way.

It is hereby determined and declared that the authority and the carrying out of its powers, purposes and duties are in all respects for the benefit of the people of the city of Schenectady and the state of New York, and that said purposes are public purposes and that the authority is and will be performing an essential governmental function in the exercise of the powers conferred upon it by this title. * NB Authority ceased to exist 08/05/2002 * NB There are 4 § 1599-c’s
