N.Y. Public Buildings Law Section 41
Jurisdiction


1.

Hereafter no work of art shall become the property of the state by purchase, gift or otherwise, or be paid for, either wholly or in part, out of state funds, unless such work of art or design for the same, together with a statement of the proposed location of such work of art shall first have been submitted to and approved by the office of general services; nor shall any work of art, until so approved, be erected or placed in or upon or allowed over or upon any state building, street, highway or other public place, park or ground belonging to or under control of the state. No existing work of art, belonging to or in possession of the state, shall be removed, relocated or altered in any way without the approval of the office of general services.

The construction of any building, bridge or its approaches, arch, gate, fence or other structure, or fixture, which is to be paid for, either wholly or in part, by state funds, or to be constructed on land owned or controlled by the state, shall not be begun unless the design for the same shall have been submitted to and approved by the office of general services.

No arch, bridge, approach or other structure belonging to any private individual or corporation shall be permitted to extend over or under, into or upon any street, highway, waterway or other public place, belonging to or under control of the state, unless the design and location thereof shall have been submitted to and approved by the office of general services.

The office of general services shall advise, generally, upon questions of art or architecture, when requested to do so, by the governor, any legislative committee, head of a state department or commission.

5.

If the office of general services should fail to decide upon any matter submitted to it, within forty-five days after such submission, the office’s approval of the matter shall be presumed.
