N.Y. Public Buildings Law Section 40
Definitions


As used in this article 1. The term “work of art” shall apply to and include all paintings, mural decorations, stained glass, sculptures, bas-reliefs, fountains, monuments, arches, gateways and other structures of a permanent nature intended for ornamentation or commemoration.

The term “building” shall apply to and include all monumental or other buildings for housing any of the state departments or commissions or intended as memorials, museums or places of public assemblage, and shall not apply to or include any buildings for institutional, hospital, penal or corrective purposes.
