Department authority


The department shall make such rules and regulations governing the issuance and use of falconry licenses as it shall deem proper and necessary, giving due consideration to the recommendations of the falconry advisory board. The department may fix by regulation special open seasons for the taking of small game or upland game birds by falconry. The department may revoke any falconry license and may seize raptors held pursuant thereto if the licensee (i) fails to provide proper care for the raptors in the licensee’s possession, (ii) allows raptors in the licensee’s possession to become a public nuisance, (iii) is convicted of or settles by civil compromise any violation of any provision of this chapter or regulation of the department, or

(iv)

fails to comply with any of the terms or conditions of the falconry license.
