N.Y. Education Law Section 4802
Acquisition of lands and erection of buildings


Upon the adoption of the resolution as provided in section forty-eight hundred one, the city, through its properly constituted officers having power and jurisdiction therein, shall lease or purchase land in a convenient, accessible place in the county in which such city is located and not less than six miles from the center of the city to be used for the purpose of such school. Such land may be acquired by gift, purchase or condemnation. The land when so acquired shall be held in the name of the city for the benefit of such school. Upon acquisition of such land the city shall erect the necessary buildings and suitably equip them for use. Such city may also provide for the improvement of existing buildings and make such repairs and alterations upon the buildings upon the land used for the purposes of the school as may be necessary for the maintenance and operation thereof.
