N.Y. Real Property Law Section 447-D
Exceptions


This article shall not apply to:

1.

Incidental and occasional occupancy of such dwelling unit for fewer than thirty consecutive days by other natural persons when the permanent occupants are temporarily absent for personal reasons, such as vacation or medical treatment, provided that there is no monetary compensation paid to the permanent occupants for such occupancy; or

2.

A municipality which does not allow short-term residential rentals; provided, however, that such municipality shall request an exception from this article; or

3.

Temporary housing or lodging permitted by the department of health. * NB Effective April 20, 2025
