N.Y. Environmental Conservation Law Section 49-0111
Grants or gifts

The department, with the approval of the Governor, may accept as agent of the state any gift, devise or bequest, whether conditional or unconditional (notwithstanding the provisions of State Finance Law § 11 (Gifts, devises and bequests)section 11 of the State Finance Law), and including federal grants, for any of the purposes of this article. Any moneys so received may be expended by the department to effectuate any purpose of this article, subject to the same limitations as to approval of expenditures and audit as are prescribed for state moneys appropriated for the purposes of this article.
