N.Y. Energy Law Section 11-108
Penalties


1.

Any person having been served with an order to remedy a violation of the code pursuant to the provisions of any local law or ordinance, or the procedures adopted pursuant to Executive Law § 381 (Administration and enforcement of the New York state uniform fire prevention and building code and the New York state energy conservation...)section three hundred eighty-one of the executive law, who shall fail to comply with such order within thirty days after such service or within the time fixed by such order for compliance, whichever is greater, and any owner, builder, architect, engineer, contractor or subcontractor taking part or assisting in the construction or use of any building who shall knowingly violate any applicable provisions of the code or any lawful order of the governmental entity responsible for the administration and enforcement thereof shall be punishable by a fine of not more than one thousand dollars or by imprisonment of not more than thirty days in jail, or both.

Except as provided otherwise by law, any such violation shall not be a crime and the penalty or punishment imposed therefor shall not be deemed for any purpose a penal or criminal penalty or punishment, and shall not impose any disability upon or affect or impair the credibility as a witness, or otherwise, of any person convicted thereof.
