N.Y. Economic Development Law Section 440
Prohibition of anti-competitive behavior


A sponsoring campus, university or college shall not accept any application to locate in a tax-free NY area under subdivision one of § 436 (Businesses locating in tax-free NY areas)section four hundred thirty-six of this article from a business that would compete with other businesses in the same community but outside the tax-free NY area, and the commissioner shall reject any application under subdivision two of § 436 (Businesses locating in tax-free NY areas)section four hundred thirty-six of this article upon determining that the business would compete with other businesses in the same community but outside the tax-free NY area. The commissioner shall issue and promulgate such rules and regulations as are necessary to implement this section.
