N.Y. Navigation Law Section 140
Definitions


As used in this article, the following terms shall mean and include:

(a)

Municipality. A county, city, town, or village; a county, city, town or village on behalf of an improvement district; or any two or more of the foregoing which are acting jointly in connection with a project.

(b)

Federal government. The federal government or any agency or officer thereof.

(c)

Harbor of refuge. A harbor or navigational improvement designed primarily to enhance recreational boating, which is constructed or improved by the federal government and which requires state participation.

(d)

Local marine facility. A harbor or navigational improvement designed primarily to enhance recreational boating, a facility appurtenant or incidental thereto, or a facility appurtenant or incidental to a harbor of refuge, which is constructed or improved by a municipality.

(e)

State marine facility. A harbor or navigational improvement which is designed to enhance recreational boating, a facility appurtenant or incidental thereto, a facility appurtenant or incidental to a harbor of refuge, a storm alert system or components thereof, navigational aides, and any other similar capital improvement designed primarily to enhance recreational boating, which is constructed or improved by the commissioner.

(f)

Marine project or project. A harbor of refuge, local marine facility or state marine facility, as the case may be.
