§ 282. Entry, publication, posting and effective date of ordinance; review by proceeding under article seventy-eight of the civil practice law and rules.

Every ordinance or local law and every amendment to an existing ordinance or local law (including any map incorporated therein) adopted pursuant to the provisions of this article shall be entered in the minutes of the board and a copy thereof (exclusive of the map incorporated therein) shall be published at least once in the official newspaper and a copy thereof together with a copy of any map incorporated therein shall be posted conspicuously in the office of the village clerk or on the sign board maintained by the town clerk pursuant to subdivision six of Town Law § 30 (Powers and duties of town clerk)section thirty of the town law, as the case may be, and affidavits of the publication and posting thereof shall be filed with the clerk. Such ordinance or local law shall take effect ten days after such publication and posting; but such ordinance or local law shall take effect from the date of its service as against any person or corporation served personally with a copy thereof, certified by the clerk under the corporate seal of the village or town, as the case may be, and showing the date of its passage and entry in the minutes of the board.

When such ordinance or local law has been entered, published and posted as provided in subdivision one of this section, the adoption of such ordinance or local law shall be presumptive evidence of the regularity of all proceedings for the establishment of such area or the extension of an existing area and of all other actions taken by the board in relation thereto.

Any person or corporation aggrieved by any determination or action of the board taken pursuant to the provisions of this article may review the same by a proceeding under article seventy-eight of the civil practice law and rules provided that the application for such order of review is made within four months from the first date of the publication and posting of copies of such ordinance as provided in subdivision one of this section. All determinations and actions of the board taken pursuant to this article shall be final and conclusive unless application has been made for such review within four months from the date of such publication and posting.
