N.Y. General Business Law Section 38
Prohibited sales


No itinerant vendor, except for an authorized manufacturer’s representative or authorized distributor, shall offer for sale any of the following items:

1.

Food manufactured and packaged for sale for consumption by a child under the age of two years; or

2.

Drugs as defined in Public Health Law § 3302 (Definitions of terms of general use in this article)section three thousand three hundred two of the public health law.
