N.Y. General Business Law Section 109
Delivery of goods without obtaining negotiable warehouse receipt


A warehouseman, or any officer, agent or servant of a warehouseman who delivers goods out of the possession of such warehouseman, knowing that a negotiable warehouse receipt the negotiation of which would transfer the right to the possession of such goods is outstanding and uncanceled, without obtaining the possession of such negotiable warehouse receipt at or before the time of such delivery, shall, except in the cases provided for in sections 7-210 and 7-601 of the uniform commercial code or if the goods have been lawfully sold or disposed of because of their perishable or hazardous nature, be guilty of a misdemeanor.
