Cancellation of registration


1.

The commissioner, in accordance with the procedures specified in this article may cancel the registration of a pesticide whenever it does not appear that the article or its labeling or other material required to be submitted complies with the provisions of this article.

2.

Whenever the commissioner determines that registration of a pesticide should be canceled, he shall notify the registrant of his action and the reasons therefor.

3.

A cancellation of registration shall be effective thirty days after service of the foregoing notice unless within such time the registrant (a) makes the necessary corrections;

(b)

files a petition requesting that the matter be referred to an advisory committee; or

(c)

files objections and requests a public hearing.
