N.Y. Racing, Pari-Mutuel Wagering and Breeding Law Section 1364
Smoking prohibited

Smoking shall not be permitted, and no person shall smoke in the indoor areas of facilities licensed pursuant to this article, except that the provisions of Public Health Law § 1399-Q (Smoking and vaping restrictions inapplicable)section one thousand three hundred ninety-nine-q of the public health law shall be applicable to facilities licensed pursuant to this article.
