N.Y. Public Service Law Section 3-A
Transfer of lands


Notwithstanding any other provision of law, any land, property, right, easement or fee under the jurisdiction of the commission acquired in the name of the people of the state of New York for the purpose of the construction, maintenance or development of a grade crossing elimination project or acquired pursuant to any laws applicable to grade crossing eliminations which is determined by the commissioner of transportation to be of use or benefit for state transportation purposes is transferred to the commissioner of transportation. The commissioner of general services is authorized to convey to the city of New York any of said parcels or interests which the commissioner of transportation determines not to be necessary for state transportation purposes. Such conveyances may be made on such terms and conditions as the commissioner of general services may determine.
