N.Y. Environmental Conservation Law Section 3-0115
Establishment of forestry and wildlife management areas by United States

  • consent of state

1.

To implement and supplement federal statutes now in effect and to authorize the acquisition by the United States of America of upland area for conservation purposes, the consent of the State of New York is hereby granted to the United States of America:

a.

To acquire, on or before July 1, 1940, by means of purchase, devise, gift or condemnation such upland areas in the State of New York and outside the statutory boundaries of the Adirondack and Catskill parks as are necessary and suitable for forestry and wildlife management areas; and

b.

To forest or reforest such areas and to construct or erect upon such lands, such truck trails, bridges, ditches, fire lanes, water holes, service structures and similar improvements as are necessary for the protection and administration of these lands as forestry or wildlife management areas; and

c.

To hold title to such upland areas herein described and heretofore acquired for the foregoing purposes, reserving, however, to the State of New York, full and complete jurisdiction and authority over all such areas not incompatible with the administration, maintenance, and protection thereof by the United States of America; provided, however, that the United States of America shall make no regulations governing such areas which shall be in conflict with the provisions of the Conservation Law, as amended or as may hereafter be amended, or those provisions of the Environmental Conservation Law of the State of New York which were derived from the Conservation Law.

Such lands as are under contract of purchase by the United States of America, or to acquire which condemnation proceedings have been commenced on or before July 1, 1940 shall be deemed acquired within the meaning of paragraph a of subdivision one of this section.
