N.Y. Criminal Procedure Law Section 130.40
Summons

1.

A summons may be served by a police officer, or by a complainant at least eighteen years old or by any other person at least eighteen years old designated by the court.

2.

A summons may be served anywhere in the county of issuance or anywhere in an adjoining county.
