N.Y. Agriculture & Markets Law Section 434
Waiving of requirements authorized

The commissioner is hereby authorized to waive the requirements established pursuant to this article during a disaster emergency, provided that an official declaration of such disaster emergency has been made by the governor or his or her delegated state official pursuant to Executive Law § 28 (State declaration of disaster emergency)section twenty-eight of the executive law.
