N.Y. Retirement & Social Security Law Section 1301
Election of benefit enhancements


a.

The state of New York may elect to provide its employees the benefit enhancements provided for in § 1302 (Benefit enhancements)section thirteen hundred two of this article.

b.

A separate election to provide benefit enhancements pursuant to subdivision a of this section must be made for each specific collective bargaining organization, recognized or certified pursuant to article fourteen of the civil service law.

c.

Such election is made by the governor to the retirement system upon receipt of a request from the collective bargaining organization, recognized or certified pursuant to article fourteen of the civil service law to represent such eligible employees. No such petition shall be required for employees who are not represented for the purposes of collective bargaining subject to the limitation provided in § 902 (Benefit enhancements)section nine hundred two of this chapter.
